Welcome to Bakersfield eSports Center. These Terms of Service ("Terms") cover your use of our website, our facility, our gaming equipment, and all services we offer, including walk-in play, PC and console gaming, virtual reality, tournaments, parties, and private events. By entering our facility, checking in, using any gaming station, booking a service, or using our website, you agree to these Terms and to our facility rules. If you do not agree, please do not use our facility, equipment, website, or services.
1. Eligibility and Acceptance
Our services are available to guests of all ages, subject to the following conditions:
- Guests under the age of 18 must have parental or guardian consent to use our facilities and services.
- A parent or legal guardian is responsible for completing registrations, bookings, and any required authorizations on behalf of a minor guest.
- You must provide accurate, current, and complete information when registering for events, making bookings, creating a gaming account, or submitting forms on our website.
2. Assumption of Risk
Gaming, esports, virtual reality, and related activities carry certain inherent risks. These may include, but are not limited to:
- Eye strain, headaches, fatigue, or dizziness
- Discomfort or repetitive-motion strain in the hands, wrists, neck, shoulders, or back
- Reactions to flashing lights or intense visual effects, including photosensitivity or seizure-related concerns
- Motion sickness or disorientation, particularly during virtual reality play
- Slips, trips, falls, or collisions while moving through the facility or while wearing a VR headset
- Exposure to online multiplayer interactions, competitive conduct, or game content that may not be suitable for all ages
By visiting our facility and using our equipment and services, you voluntarily accept these risks for yourself and for any minor in your care.
3. Health and Safety
Guests are responsible for monitoring their own condition while playing. Take regular breaks, and stop playing immediately if you feel eye strain, headache, dizziness, nausea, pain, or any other discomfort. Guests with a history of seizures, photosensitivity, migraines, motion sickness, or similar medical concerns should consult a medical professional before playing, and are especially encouraged to do so before using virtual reality equipment. Bakersfield eSports Center does not provide medical advice, medical supervision, or childcare.
4. Guest Conduct and House Rules
Bakersfield eSports Center is a community gaming space enjoyed by guests of all ages, and we work hard to keep it welcoming, safe, and fun. All guests must follow staff instructions, posted signage, and the rules below.
4.1 House Rules
- No outside food or drink. Please leave outside food and beverages at home or in your vehicle; refreshments purchased at Bakersfield eSports Center are welcome, but keep them clear of the equipment.
- No smoking or vaping of any kind. This includes cigarettes, e-cigarettes, vape pens, and any similar device, anywhere inside the facility.
- No alcohol. Alcoholic beverages may not be brought into or consumed at the facility, and guests who appear intoxicated may be refused entry or asked to leave.
- No drug use. Illegal drugs and drug use of any kind are strictly prohibited on the premises.
- No weapons. Weapons of any kind are not allowed anywhere on the property.
- Keep the language clean. Foul, vulgar, or offensive language does not belong in our center. Many of our guests are kids, so speak like they're standing next to you, because they probably are.
- No toxicity in games. Win or lose, keep it sportsmanlike. Raging at teammates, insulting opponents, griefing, or any other toxic in-game behavior is not tolerated, whether directed at guests in the center or at players online.
- No shirt, no shoes, no entry. A shirt and footwear are required to enter and must stay on while you're here.
- No throwing objects. Do not throw controllers, headsets, or anything else. If it leaves your hand in frustration, your session may leave with it.
4.2 Prohibited Conduct
In addition to the house rules, the following conduct is not permitted:
- Harassment, bullying, threats, hate speech, or abusive language toward staff or other guests
- Fighting, roughhousing, or other unsafe or disruptive behavior
- Cheating, hacking, account sharing, or attempting to bypass security or account controls
- Tampering with computers, consoles, VR equipment, cables, peripherals, network hardware, software, or settings
- Installing unauthorized software or accessing inappropriate or illegal content
- Damaging, misusing, moving, or removing facility equipment or property
- Theft or attempted theft
- Any other conduct that management determines creates a safety risk or a poor experience for other guests
Violation of these rules may result in loss of remaining play time, removal from the facility, or denial of future access, without refund.
5. Equipment Use and Damage
Our gaming PCs, consoles, VR headsets, monitors, peripherals, chairs, and other equipment are provided for your use during your visit and must be used properly and responsibly. You are responsible for any damage caused by misuse, negligence, recklessness, or failure to follow staff instructions. For minor guests, the parent or legal guardian is responsible for damage caused by the minor. Bakersfield eSports Center may charge the responsible guest, parent, or guardian for the cost of repair, replacement, or cleaning resulting from damage or misuse.
6. Personal Property
Guests are responsible for their own belongings. Bakersfield eSports Center is not responsible for lost, stolen, or damaged personal items, including phones, wallets, bags, personal peripherals, or other devices, except where liability cannot be waived under California law. Guests who bring their own peripherals or equipment do so at their own risk.
7. Payments and Refunds
All payments for services, bookings, and event registrations are processed through our authorized payment processors.
7.1 Gaming and VR Time
All purchases of play time, including PC gaming, console gaming, and Virtual Reality sessions, are final. No refunds will be issued for time purchased on our computers or Virtual Reality equipment. If you experience a technical issue with any station or equipment, please bring it to the attention of our staff right away so we can promptly assist you.
7.2 Events, Parties, and Bookings
- Refund requests for scheduled events, parties, or bookings must be submitted at least 48 hours before the scheduled service or event
- Refunds are issued at the discretion of Bakersfield eSports Center
- No refunds will be provided for services already rendered or events already attended
- No refund is owed when access is suspended or a guest is removed due to rule violations or misconduct
8. Event Registration and Tournaments
When registering for events or tournaments:
- Registration details and fees are specified on the event listing and are subject to change
- Bakersfield eSports Center reserves the right to modify event schedules, formats, brackets, prizes, or rules when needed for fairness, safety, or operations
- Events, parties, and private bookings may carry additional rules, payment terms, or supervision requirements, and participants must follow them
- Participants must adhere to all tournament rules and codes of conduct
- Disqualification may result from unsportsmanlike conduct, cheating, or violation of event rules
9. SMS Communications and Consent
Bakersfield eSports Center offers optional SMS messaging programs. By opting in through our sign-up form, you may consent to receive text messages in the following categories:
- Tournament & Event Alerts: Schedules, brackets, registration deadlines, and event announcements
- Promotional Offers: Exclusive deals, discounts, and special offers
- General Updates: News, new features, and facility updates
Each message category is a separate opt-in. You may choose one or more independently. Key details:
- Message frequency: up to 4 messages per week
- Message and data rates may apply
- Reply STOP at any time to cancel all SMS messages
- Reply HELP for assistance
- Consent to receive SMS messages is not a condition of purchase or use of our services
10. Website and Online Services
Our website, booking tools, and online services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted website access, error-free operation, or the availability of any specific game, station, or online service during your visit. You may not scrape, copy, reverse engineer, interfere with, or attempt unauthorized access to our website, network, systems, or accounts.
11. Intellectual Property
All content on the Bakersfield eSports Center website, including text, graphics, logos, images, and software, is the property of Bakersfield eSports Center or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
12. Photos, Video, and Security Cameras
Bakersfield eSports Center uses security cameras within the facility for safety, security, loss prevention, and incident review. Separately, we may photograph, record, or stream events, tournaments, and parties for promotional use. Where required, we will request a media release or parental consent before using identifiable photos or video of a minor for promotional purposes. Please note that other guests, participants, or streamers may capture their own photos or video during public events.
13. Release and Waiver of Liability
To the fullest extent permitted by California law, you release and agree not to bring claims against Bakersfield eSports Center, its owners, officers, employees, contractors, and agents for claims arising out of your visit, your use of the facility or equipment, or your participation in any activity, event, tournament, party, or booking, including claims arising from ordinary negligence. This release covers claims for personal injury, property damage, economic loss, and loss of personal property or data. This release does not apply to claims that cannot be waived under California law, including those arising from gross negligence, willful misconduct, fraud, or violations of law.
14. Limitation of Liability
To the fullest extent permitted by law:
- Bakersfield eSports Center is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, facilities, or services
- Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim
15. Indemnification
You agree to indemnify and hold harmless Bakersfield eSports Center, its owners, officers, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms or of law, damage to property caused by you, or infringement of any third-party rights. For minor guests, the parent or legal guardian agrees to this indemnification to the fullest extent permitted by law.
16. Right to Refuse Service
Bakersfield eSports Center reserves the right to refuse service, suspend access, end a session, remove a guest, or deny future entry when management determines that a guest has violated these Terms, created a safety concern, disrupted operations, damaged property, or harassed staff or other guests. No refund is owed when removal or suspension results from rule violations or misconduct.
17. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting the revised Terms on this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Kern County, California.
19. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining portions will continue in full force and effect to the fullest extent permitted by law.
